ACA International's Guide to the Fair Debt Collection Practices Act

ACA International's Guide to the Fair Debt Collection Practices Act comes as a pdf providing a detailed and comprehensive overview of the provisions of the Fair Debt Collection Practices Act (FDCPA) and its implementing regulations, as well as issues that arise under these laws.

With the 2022 edition, this Guide incorporates new case law as well as the provisions of the final “Debt Collection Rule” (Regulation F or, colloquially, “Reg F”), the federal regulation that implements the FDCPA. The Consumer Financial Protection Bureau (CFPB) issued wide-ranging substantive amendments to Reg F in two parts on October 30, 2020, and December 18, 2020. The complete final rule took effect on November 30, 2021. It has been codified at 12 C.F.R. Part 1006.

This Guide additionally includes the complete statutory text of the FDCPA and Reg F, as well as a jurisdictional map of United States Circuit Courts of Appeals.

As creditors and their ARM business and service providers prepare for the Reg F effective date of November 30, 2021, interesting questions arise about the documentation and retention requirements and standards those new federal regulations impose. It will be critical for Reg F compliance to assure that documentation that evidences your compliance (and potentially non-compliance) is developed and preserved for three or more years. So now is a great time for creditors to map out any expectations they have for documentation collection agencies should prepare and any retention requirements for documentation and other artifacts of compliance (e.g., call recordings). This webinar designed for the creditor perspective explores the Reg F documentation and retention expectations and offers practical guidance for navigating those requirements.

Another piece of the proposed debt collection rulemaking puzzle from the Consumer Financial Protection Bureau is in place after the bureau released its 103-page Supplemental Notice of Proposed Rulemaking (SNPRM) concerning out-of-statute debt, which ACA has been expecting and preparing for over the past several months. During this webinar, participants will summarize what the SNPRM includes and discuss how it may impact business operations and current compliance systems, including analysis about how it may conflict or overlap with state requirements. ACA will help members understand how this could change the way they collect on out-of-statute debt, and provide an opportunity for questions and the ability to provide feedback on the proposal.
