ACA International's Guide to the Fair Debt Collection Practices Act comes as a pdf providing a detailed and comprehensive overview of the provisions of the Fair Debt Collection Practices Act (FDCPA) and its implementing regulations, as well as issues that arise under these laws.


With the 2022 edition, this Guide incorporates new case law as well as the provisions of the final “Debt Collection Rule” (Regulation F or, colloquially, “Reg F”), the federal regulation that implements the FDCPA. The Consumer Financial Protection Bureau (CFPB) issued wide-ranging substantive amendments to Reg F in two parts on October 30, 2020, and December 18, 2020. The complete final rule took effect on November 30, 2021. It has been codified at 12 C.F.R. Part 1006.


This Guide additionally includes the complete statutory text of the FDCPA and Reg F, as well as a jurisdictional map of United States Circuit Courts of Appeals.

ACA's Guide to State Laws and Collection Practices Now Offers Bespoke Excel Spreadsheets


In its relentless pursuit to curate the most accurate user-friendly guide to state collection laws, ACA has developed a bespoke spreadsheet feature for subscribers. This new feature allows subscribers to choose the states, headings and subheadings they want to see in one document. Providing the subscriber with a concise document, focusing only on the states and laws of interest with a few clicks of the mouse.


Under the “explore ARM topics by category” section on the State Guide page, subscribers can choose which topics they are interested in such as garnishment exemptions and general credit reporting restrictions. Next, they can choose which states or territories they want to review. After the selection are made, the subscribers can simply click on the “Submit” button and the custom spreadsheet will download and be ready to review. Being able to select what states and laws are included in a spreadsheet allows subscribers to quickly access the information that is relevant to them without having to wade through pages of information or toggle between several documents.

 

Need to access a state chapter or topical file? Subscribers can navigate to these sections of the guide with one mouse click from this tool. Clicking on the icon behind each topic or state will take you to the full topical chapter or state chapter.
